Terms of Service

These Terms of Service (“Terms”) govern your access to and use of our Services. Our Services include our website, email notifications, SMS, applications, advertisements, and commerce services. Any information, text, graphic, photo or other material uploaded, downloaded or appearing on the Services will be referred to as Content. Please read this Agreement carefully before accessing or using our Services. By accessing or using any part of our Services, you agree to become bound by the Terms of this agreement. If you do not agree to all the Terms of this agreement, then you may not access or use any of our Services.

1. Terms Overview

You are responsible for your use of the Services, for any Content you post to the Services, and for any consequences that result. The Content you post through the Services is public by default in most instances and will be viewable by other users and through third party services and websites. 

If you are a person barred from receiving services under the laws of the United States or other applicable jurisdiction then you cannot use the Services. If you are accepting these Terms and using the Services on behalf of a government official, candidate, or other legal entity, you represent and warrant that you are authorized to do so. To use the Services, you must comply with these Terms and all applicable local, state, national, and international laws, rules, and regulations. 

The Services that Ulection provides may change or be removed and new Services may be added without you first being notified. 

Ulection and its third party providers have the right to choose where advertisements are placed on the Services. 

2. Passwords

Ulection encourages you to use a strong password to help protect your account. A strong password is a password which contains a combination of upper and lower case letters, numbers, and symbols. It is your responsibility to protect the password that you use to access the Services. You understand that you are responsible for any activities or actions which occur under your password. Under no circumstances will Ulection be held liable for any activities or actions that result from your password being compromised. 

3. Privacy

It is necessary to review the Ulection Privacy Policy to learn about how the information you provide to Ulection is collected and used. Accepting these Terms confirms that you have read and agree to the Privacy Policy. 

4. Publicly Posted Content

Ulection cannot be held liable for any Content that is publicly posted by our users or third parties on the Services or any damages that occur as a result. In the event that an issue arises, the user who originated the Content will be the liable party. We are also not responsible for monitoring all Content that is publicly posted by our users, or third parties on the Services. And Ulection will not be held responsible for any damages that occur at an event that was created using our Services. Please read the Community Rules to fully understand which behaviors will be subject to account termination and removal of posts. Accepting these Terms confirms that you have read and agree to the Community Rules. 

You retain your rights to any Content you post through the Services. By posting Content through the Services, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such Content in any and all media or distribution methods.

Ulection will not endorse or promote any user Content posted on the Services. The approval rating of Candidates and Elected Officials and the Posts showing in our Trending section do not constitute endorsement or promotion, as these are determined by our users. Ulection is also not responsible or liable for any links to third-party websites or resources contained on the Services. The advertisements appearing on the Services are done through Google Adsense and Ulection does not endorse or promote any content, products, or services being advertised.

Please note that even though the creators of Ulection want all Content posted on the Services to be accurate and reliable, we cannot guarantee the accuracy or reliability of all publicly posted user Content. If a user continuously creates Content that is misleading, inaccurate, or unreliable then their account may be subject to termination at our discretion.

5. Restrictions

Ulection reserves the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to (1) satisfy any applicable law, regulation, legal process or governmental request, (2) enforce the Terms, including investigation of potential violations hereof, (3) detect, prevent, or otherwise address fraud, security or technical issues, (4) respond to user support requests, or (5) protect the rights, property or safety of Ulection, its users and the public.

You may not do any of the following while accessing or using the Services: (1) access, tamper with, or use non-public areas of the Services, Ulection’s computer systems, or the technical delivery systems of Ulection’s providers; (2) probe, scan, or test the vulnerability of any system or network or breach or circumvent any security or authentication measures; (3) access or search or attempt to access or search the Services by any means (automated or otherwise) other than through our currently available, published interfaces that are provided by Ulection (and only pursuant to the applicable Terms), unless you have been specifically allowed to do so in a separate agreement with Ulection; (4) forge any TCP/IP packet header or any part of the header information in any email or posting, or in any way use the Services to send altered, deceptive or false source-identifying information; or (5) interfere with, or disrupt, (or attempt to do so), the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, mail-bombing the Services, or by scripting the creation of Content in such a manner as to interfere with or create an undue burden on the Services.

6. Commerce Terms

In order to donate to Ulection, you will be required to provide information regarding your credit or debit card. You represent and warrant to Ulection that the information you provide is true and that you are authorized to use the payment instrument. You agree that all donation payments are final and cannot be refunded. 

Ulection is not a broker, financial institution, creditor, or charitable institution. Your donations are submitted through the donation feature connected to the Ulection Stripe account, a secure and top rated payment processor. We have taken every step to ensure that your payment information and transactions are secure. 

7. Ulection Rights

All right, title, and interest in and to the Services (excluding Content provided by users) are and will remain the exclusive property of Ulection and its licensors. Nothing in the Terms gives you a right to use the Ulection name or any of the Ulection trademarks, logos, domain names, and other distinctive brand features. 

8. Copyright Infringement and DMCA Policy

As Ulection asks others to respect its intellectual property rights, it respects the intellectual property rights of others. If you believe that material located on or linked to by Ulection violates your copyright, you are encouraged to notify Ulection in accordance with Ulection’s Digital Millennium Copyright Act (“DMCA”) Policy. Ulection will respond to all such notices, including as required or appropriate by removing the infringing material or disabling all links to the infringing material. Ulection will terminate a user's access to and use of the Services if, under appropriate circumstances, the user is determined to be a repeat infringer of the copyrights or other intellectual property rights of Ulection or others. In the case of such termination, Ulection will have no obligation to provide a refund of any amounts previously paid to Ulection.

9. Ending These Terms

You may end your legal agreement with Ulection at any time by deactivating your account and discontinuing your use of the Services. You do not need to specifically inform Ulection when you stop using the Services. 

10. Disclaimer of Warranties

Our Services are provided “as is.” Ulection and its third parties hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither Ulection nor its third parties and partners, makes any warranty that our Services will be error free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, our Services at your own discretion and risk.

11. Limitation of Liability 

In no event will Ulection, or its third parties be liable with respect to any subject matter of this Agreement under any contract, negligence, strict liability or other legal or equitable theory for: (1) any special, incidental or consequential damages; (2) the cost of procurement for substitute products or services; or (3) for interruption of use or loss or corruption of data. Ulection shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.

12. Controlling Law and Jurisdiction

These Terms and any action related thereto will be governed by the laws of the State of California without regard to or application of its conflict of law provisions or your state or country of residence. All claims, legal proceedings or litigation arising in connection with the Services will be brought solely in the federal or state courts located in San Diego County, California, United States, and you consent to the jurisdiction of and venue in such courts and waive any objection as to inconvenient forum.

If you are a federal, state, or local government entity in the United States using the Services in your official capacity and legally unable to accept the controlling law, jurisdiction or venue clauses above, then those clauses do not apply to you. For such U.S. federal government entities, these Terms and any action related thereto will be governed by the laws of the United States of America (without reference to conflict of laws) and, in the absence of federal law and to the extent permitted under federal law, the laws of the State of California (excluding choice of law).

13. Terms Revisions

We may revise these Terms from time to time. The most current version will always be at Ulection.com/Terms. If the revision contains information which we believe is a significant change from what is already published then we will notify you. By continuing to access or use the Services after those revisions become effective, you agree to be bound by the revised Terms.
